34 <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers - Mohr, Pico, Scribner, and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 12d <br /> Proposed Chanqes to California Environmental Oualitv Act fCEOA] <br /> recommended by Association of Bay Area Governments' (ABA~) <br /> Modifications Subcommittee <br /> <br /> Ms. Acosta indicated the Committee is meeting again tomorrow <br /> and staff is asking for Council comments on the staff <br /> recommendations to the Committee. <br /> <br /> Mr. Pico wanted assurance that the CEQA process is not being <br /> simplified to the point of having no enforcement powers. <br /> <br /> Mr. Swift indicated that is not staff or the subcommittee's <br /> intent. The subcommittee is trying to make every action litigation <br /> proof, however Mr. Swift did not believe that was possible. <br /> <br /> Mr. Tarver appreciated staffs comments and agreed the object <br /> is not to dilute CEQA, but to expedite the process. <br /> <br /> Ms. Acosta suggested that if there are no comments, that the <br /> report be sent to the Committee as it is so Council can get its <br /> comments in early. When the matter comes before the full ABAG <br /> Board, there will be another opportunity to present information. <br /> <br /> Ms. Mohr requested clarification of the court assignments. <br /> Will that mean a group of judges will handle all the CEQA cases, <br /> thus becoming more knowledgeable? <br /> <br /> Mr. Swift indicated that those in the legal profession would <br /> love to have judges who only did CEQA litigation, but that could <br /> not realistically happen in the current superior court system. <br /> <br /> It was moved by Ms. Scribner, seconded by Mr. Tarver, to pass <br /> the staff comments onto ABAG. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers - Mohr, Pico, Scribner, and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> 1/5/93 34 <br /> <br /> <br />
