20 <br /> <br /> Mr. Swift indicated short of requiring construction to start <br /> after the rainy season is past, there is no way to address the <br /> completion aspect. If they start in November and we have a 100 <br /> year storm, it doesn't matter what kind of bonding we have, it <br /> won't help. <br /> <br /> Mr. Swift indicated this means construction should not occur <br /> in winter and the City has standards about when the start of <br /> improvements should occur. Fish and Game and City requirements are <br /> that no new development occur after October 15th unless <br /> satisfactory erosion control plans are in existence, which would <br /> mitigate any concerns staff might have. <br /> <br /> Ms. Mohr asked Mr. Elliott what would bonding accomplish. <br /> <br /> Mr. Elliott indicated that if construction started next summer <br /> and there was an early storm, even if there were bonding, he was <br /> uncertain what action could be taken. <br /> <br /> Ms. Acosta indicated that if the proper erosion control were <br /> not done and the city experienced flooding and the contractor <br /> weren't. solving that problem, then the City could use that money to <br /> create whatever mitigations were necessary. <br /> <br /> Mr. Swift indicated the City routinely has that bonding <br /> anyway. There is a bond that can be used for erosion control that <br /> is put up on all new developments. Mr. Swift believed what Council <br /> was looking for was a way to complete a project in the event <br /> construction is started but not completed before the onset of the <br /> rainy season. <br /> <br /> It was moved by Mr. Pico, seconded by Ms. Scribner, to adopt <br /> Resolution 93-05, approving the vesting Tentative Map for Tract <br /> 6545, Kaufman and Broad, Inc./California Reflections, subject to <br /> the conditions in the staff report and the additional following <br /> conditions: that the right-turn only driveway be modified to <br /> include a left turn following further review by staff, to be <br /> decided by Council prior to approval of the final map; that the <br /> affordable units be distributed throughout the development; and for <br /> staff to explore the concerns raised about bonding and the <br /> completion of public improvements, with a decision to be made <br /> later. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Mohr, Pico, Scribner, and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> 1/5/93 20 <br /> <br /> <br />
