16 <br /> <br /> It was moved by Mr. Pico, and seconded by Mayor Tarver, that <br /> the appeal of the Tentative Map for PUD-91-17 be upheld. <br /> The roll call vote was as follows: <br /> AYES: Councilmember Pico and Mayor Tarver <br /> NOES: Councilmembers Mohr and Scribner <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Ms. Scribner inquired if Council could do anything to insure <br /> that Kaufman and Broad continue to deal with Mr. Irby to reach a <br /> fair settlement for the right of way. <br /> <br /> Mr. Swift indicated Mr. Irby's interests are protected whether <br /> the developer negotiates or the City is required to negotiate <br /> <br /> Mr. Scribner then asked about the change to accommodate a left <br /> hand turn out of the project onto Stanley. Mr. Elliott said staff <br /> could change that plan <br /> <br /> Ms. Acosta stated that if Council wishes to make changes to <br /> the tentative map or add conditions to the project, it is necessary <br /> to approve the Map in order to modify the conditions. <br /> <br /> Mr. Tarver stated that if he has to approve the tentative map <br /> in order to improve the project, he wants Conditions 19 (eminent <br /> domain) changed; wants a left hand turn lane other than the one <br /> that is proposed; and wants bonding for the timing and completion <br /> of infrastructure. <br /> <br /> Ms. Mohr asked staff if Council can remove the prohibition on <br /> left turns at any time. <br /> <br /> Mr. Swift indicated it can, however, once the developer <br /> installs it, any modification will be at the City's expense. If <br /> Council decides it wants the left hand turn, it should do so now so <br /> the developer can pay for it. <br /> <br /> Mr. Tarver suggested that Council discuss the major changes <br /> desired then continue approval to the next meeting, so the wording <br /> of the conditions could be prepared. <br /> <br /> Mr. Pico indicated his preference that there are fewer two <br /> story homes along Stanley Boulevard; some provisions that the <br /> sixteen affordable units are not clustered adjacent to the railroad <br /> tracks. <br /> <br /> Ms. Mohr indicated the left turn lane was a reasonable change. <br /> <br /> Mr. van Gelder indicated staff had recommended against the <br /> left turn because of safety reasons. Staff could prepare a summary <br /> of how that conclusion was reached and Council could decide then. <br /> However, he did agree with Mr. Callahan that if an appropriate <br /> <br /> 1/5/93 16 <br /> <br /> <br />
