190

It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Resolution No. 93-101,
be adopted, approving the form and substance of a Trust Agreement and authorizing changes __
thereto and execution thereof (1993 Reassessment Revenue Bonds, Series A and B).

The roll call vote was as follows:
AYES: Councilmembers Dennis, Mohr, Pico, Scribner and Mayor Tarver
NOES: None
ABSENT: None
ABSTAIN: None

6, PRQPQSED AGREEMENT WITH THE CITY QF HAYWARD AND ALAMEDA
COUNTY; CITY COUNCIL SPONSORED RIDGELANDS INITIATIVE (SR93:321)

Mr. Roush presented the staff report. He responded to Council's questions regarding
Measure M, the hold harmless provisions, and potential litigation concerning the Agreement.

Ms. Mohr objected to the Pleasanton taxpayers having to pay for the County's litigation
expenses and damages.

There was general discussion on the recommendations made by the Planning Commission
and the General Plan Steering Committee.

Mr. Swift explained the differences in the County's, Hayward's and Pleasnaton's General
Plans. He described the proposed trails and vehicles access routes.

Mr. Roush stated that if Council wants the proposed General Plan amendment to be
consistent with and parallel to the City of Hayward and Alameda County General Plans, it
should delete aggregating non-contiguous properties for density transfer purposes.

Ms. Mohr requested that a termination clause be added to this agreement. She asked how
the other Councilmembers felt about this type of clause.

Mr. Pico could support termination language that was very general.

Mayor Tarver and Ms. Dennis did not believe that a termination clause was necessary.

Mr. Tarver asked if any member of the public wished to be heard.

Marti Greist, 5470 Foothill Road, objected to the staff recommendation. She urged
Council not to place this initiative on the November ballot because she felt that Council had not
followed the Measure M guidelines. She felt that people are tired of listening to the property
owners' problems.

08/04/93 2
