MOBILE HOME RENT STABILIZATION ORDINANCE (SR 93:400) <br /> <br /> Mr. Roush presented the staff report regarding the proposed ordinance so as to provide <br />a way to adjust base year rents. <br /> <br /> Mr. Pico inquired why the Park Owner is not required to submit certified records rather <br />than having the City Manager hire an independent accountant to verify the information. He also <br />indicated his desire that all the documentation be a public record in order that the tenants may <br />review the information. <br /> <br /> Mr. Roush indicated the ordinance was written as it was in order that the City have some <br />means of having independent verification of the information and to have the ability to be able <br />to request more information. He also indicated that some of the documentation would refer to <br />financial information that should be protected. Mr. Roush stated that the base year rent <br />adjustment is intended to be a one-time occurrence. <br /> <br /> Ms. Mohr indicated with regard to a park owner's records, the City gets information <br />regarding business licenses which is not open to the public. <br /> <br /> Mr. Roush believed that only those parties affected would have access to the financial <br />information. <br /> <br /> Ms. Mohr indicated that would be acceptable, so long as the general public did not have <br />access. <br /> <br /> Mr. Tarver referred to the list of information the Hearing Officer will use to make a <br />determination. He believed a fourth item should be included to allow the hearing officer to <br />consider other relevant information. <br /> <br /> Mr. Roush stated that a paragraph could be added. <br /> <br /> Greg Burton, speaking for the Pleasanton Mobile Home Park, agreed that he would like <br />to have the park owner information certified and agreed that only the tenants and their <br />representatives should be able to review the financial information. He questioned the phrase <br />"comparable property" and felt it should say "comparable mobile home park property." Mr. <br />Burton questioned the $7500 application fee. He also indicated a desire to review the resumes <br />of proposed hearing officers.
