Mr. Pico inquired about the termination clause. It was his understanding that as currently <br />written, the agreement could be terminated if all parties agree. Mr. Campbell appears to be <br />suggesting that one party can terminate the agreement. Mr. Pieo also believed that in order to <br />terminate the agreement, it would require a vote of the Pleasanton citizens. <br /> <br /> Mr. Roush indicated a vote of the people was not legally required to terminate the <br />agreement. The citizens are only required to vote on a change to the general plan land use <br />designation within the Ridgelands. <br /> <br /> Ms. Dennis asked how the attorneys' fees would be paid and whether the Board of <br />Supervisors had discussed this. <br /> <br /> Mr. Roush indicated his only reference was in a letter from the County Counsel dated <br />September 22, 1993, which refers to Board action. <br /> <br /> Mr. Tarver expressed his preference that the agreement set out how the attorneys' fees <br />would be divided. <br /> <br /> Mr. Frank Neu, 18210 Carmel Drilte, presented a letter to Council which stated property <br />across 1-580 had sold for $26,000 per acre. He indicated he had received an offer from the East <br />Bay Regional Park District offering to pay $3,000 an acre for his property. He further stated <br />Mr. Lehne has been offered $1,500 per acre. He believed this agreement was a conspiracy to <br />drive down the land value so the Park District could afford to buy it. <br /> <br /> George Schneider, President of Upper Kilkare Homeowners, objected to his property <br />being included in the boundaries of the Memorandum of Understanding. <br /> <br /> David Theobald, 9893 Dublin Canyon Road, indicated he and his church wanted to build <br />housing for unwed mothers and transitional women. He inquired if he must obtain approval <br />from all three agencies. He referred to the large area of land which was excluded from the <br />boundaries of this agreement and indicated he wanted his property excluded as well. He <br />indicated this kind of housing would be objected to by Pleasanton residents, so his location is <br />ideal. He also stated he had strong support from local businesses. Mr. Theobald further stated <br />that he planned to build a retreat center on his property. <br /> <br /> Larry Butler, 7325 Altura Place, Oakland, stated that he believed he would be harmed <br />by this agreement and intends to fight it in court. He pointed out that he is one-half mile from <br />a major shopping center (Stoneridge Mall) and three of his neighbors are developing their <br />properties. He urged Council to treat him fairly. He also wanted his property excluded from <br />the agreement. <br /> <br /> Marie Cronin, 8989 Dublin Canyon Road, reiterated that the property owners and <br />residents are adamantly opposed to this agreement.
