CALL TO ORDER <br /> <br /> The meeting was called to order by Mayor Ben Tarver at 6:02 p.m. in the City Council <br />Chambers, 200 Old Bernal Avenue, Pleasanton, California. <br /> <br />2. ROLL CALL <br /> <br /> Those in attendance were: Councilmembers Dennis, Mohr, Pico, Scribner, and Mayor <br />Tarver. Staff members present were: Deborah Acosta, City Manager; Michael Roush, City <br />Attorney, and Brian Swift, Director of Planning and Community Development. <br /> <br />3. Land Use Agreement with Hayward and Alameda County (SR 93:403) <br /> <br /> Michael Roush presented the Staff Report regarding the proposed changes to the pending <br />agreement which deal with provisions concerning a third party challenge, payment of damages <br />and termination. <br /> <br /> Mr. Pico wanted clarification on whether the requested changes regarding damages and <br />termination came directly from Supervisor Campbell or from the Board of Supervisors as a <br />whole. <br /> <br /> Mr. Roush indicated Mr. Campbell had requested those changes. <br /> <br /> Ms. Mohr inquired if the damages would be paid equally by Hayward and Pleasanton and <br />further asked if there was an estimate of potential liability for damages. Mr. Roush responded <br />that it could be substantial. <br /> <br /> Ms. Scribner discussed the 1300 acres. It was indicated that 2% was in the Pleasanton <br />city limits, 7% was in the Hayward city limits, and the balance was either owned by East Bay <br />Regional Park or in Alameda County. <br /> <br /> Ms. Mohr expressed concern regarding the cities being required to retain "outside" legal <br />counsel. <br /> <br />10/1/93 <br /> 1 <br /> <br /> <br />
