39 <br /> <br /> Rick Hempy, 3568 Vine Street, and Frank Lehne, 5466 Foothill Road, both supported <br /> the gate at B Court. <br /> <br /> Marmy Joel, 5470 Foothill Road, wanted the gate at B Court with the ten custom homes <br /> behind the gate. He indicated that with respect to ownership of the land which the spring boxes <br /> are located, if the spring boxes are on the Moller property, Ms. Sorensen should have no more <br /> rights or privileges than what her predecessor received from the Garrns' predecessors in interest. <br /> <br /> Larry Butler, 7325 Altura Place, strongly supported this project and also wanted the gate <br /> at B Court. <br /> <br />CO Raili Glenn, 5650 Foothill Road, was against any public road and supported an electric <br />CO gate at B Court. <br /> <br /> Emelda Lehne, .5466 Foothill Road, indicated she was very happy with the development <br /> and wanted the gate at B Court. <br /> <br /> Jack Hovingh, 4250 Muirwood, spoke in favor of undergrounding the utilities in this <br /> area. If Council removed Condition 15, then the Council should move the utility poles to the <br /> west side of the road. <br /> <br /> Mr. Tarver reiterated the remaining issues: the gate, power poles, improvements to lots, <br /> toxic site cleanup, and public or private road to the East Bay Regional Park area. <br /> <br /> Ms. Dennis supported the neighbors' request for the location of the gate. <br /> <br /> Mx. Swift pointed out that if Council allows the road to be private and later the City <br /> wants access, then the City must buy it back. <br /> <br /> Ms. Dennis asked if there could be an open option for 25 years. <br /> <br /> Mr. Swift indicated if the Council wants an easement, it must be described for the final <br /> map. <br /> <br /> There was discussion regarding trails, staging areas needed, and potential acc, ess to the <br /> ridge. Mr. Swift stated the Moller property trail connects to the Garms property trail, but not <br /> to the ridge itself because the Garms property does not reach the ridge. The General Plan <br /> addresses proposed trails in the area. If Council anticipates a need for additional staging areas <br /> on this site, Council needs to add a condition now or take fee title to the open space. <br /> <br /> Mr. Pico supported an open offer of dedication with a potential staging area at the far <br /> end of the property where the old quarry area is located. <br /> <br /> 09/21/93 9 <br /> <br /> <br />
