42 <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Ordinance No. 1606 <br /> be introduced, to be read by title only and waiving further reading thereof, appwving PUD-90- <br /> 19-2M, but modifying Condition 16 to provide that if the spring boxes which serve the Sorensen <br /> pwperty are located on the Moller property, the developer shah grant the same rights and <br /> privileges to Ms. Sorerisen as those provided in a recorded document between A.D. Clement and <br /> I. C. Gallagher, recorded May 16, 1916, Book 2469, Page 33, Alameda County records, and <br /> including a condition that the developer provide an open offer of dedication of a public trail and <br /> staging area between B Court and the southwest comer of the site. <br /> <br /> Th~ roll call vote was as follows: <br /> AYES: Councilmembers Dennis, Mohr, and Scribner <br /> NOES: Councilmember Pico and Mayor Tarver <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Resolution No. 93-124, <br /> be adopted, denying Case AP-93-6, thereby upholding the decision of the Planning Commission <br /> and conditionally approving the application of Boulevard Development and Moller Properties for <br /> tentative map approval to subdivide a 198 acre site into 99 single-family residential lots and six <br /> remainder parcels (consisting of 163.5 acres) of open space, but including (1) that Condition 15 <br /> be modified to allow the developer to underground the utilities for one-half of the utilities on the <br /> east side of Foothill Road, and (2) that a condition be added to require that all public <br /> improvements be completed before any custom lots are sold. <br /> <br /> The roll call vote was as followF <br /> AYES: Councilmembers Dennis, Mohr and Scribner <br /> NOES: Councilmember Pico and Mayor Tarver <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> 14.
