Mavor Tarver clarified the reouested changes to the agreement: Page 4 - SecUon 1.6, the Committee shall be comprised of two City CounciimemDers and two Board members. Page 10 - Section 2.2, Subsection (e), "deemed" to be changed to "considered" where appropriate, and include a reference to Section 12.1.1 on page 19. Page 13 - Section 4.1, Homebuilder shall agree with District "and City" for alternative financing mechanisms. Page 15 - Section 6.2, reimburse Surplus Funds "with" interest. Page 28 - Exhibit B, amend Cost for Elementary School Two and Three to be $9,699,120 and change the total to $64,122,656. Include 5,000 sq.ft. cap in both agreements. It was moved by Ms. Scribner, seconded by Ms. Mohr, to approve the Cooperative Agreement, as amended. The vote was as followS: AYES: Councilmembers - Dennis, Mohr, Pico, Scribner, and Mayor Tarver NOES: None ABSENT: None ABSTAIN: None It was moved by Ms. Scribner, seconded by Ms. Mohr, to approve the Flat Fee Agreement, as amended to include the 5,000 square foot cap on the imposition of fees, to use the basic form of the Agreement for development beyond 12/31/93 and to use the basic form of the Agreement for any person who is obligated to pay school impact fees, including persons who add square footage to existing structures for bedroom purposes. The vote was as follows: AYES: Councilmembers - Dennis, Mohr, Pico, Scribner, and Mayor Tarver NOES: None ABSENT: None ABSTAIN: None Mayor Tarver indicated this sets the example of how Pleasanton will take care of the infrastructure needed for its citizens. Ms. Scribner commended all the members of the Committee, past and present, for their work in accomplishing something that will benefit the entire community. The members of the School Board unanimously voted to approve the two agreements as amended.
