recommendation that side-entry garages be incorporated whenever and wherever possible
and open fencing only. She asked for clarificationof the garage size.

Mr. Swift said the staffrecommendation is 600 square feet.

Mayor Tarver asked if Council agreed with these suggestions.

There were no objections.

Ms. Michelotti mentioned the planning for the golf course lots should be
coordinated with the flat land of the Spotorno property and lot line adjustments approved
where appropriate to make better lots. She asked for explanation of the condition that
limited the height of accessory structures.

Mr. Swirl explained there are a few lots on the east side of the bypass road that have
rear lot lines going up the hill. It was not desired to have a structure built on the upper
portion of the lot that was visible over the the house. The condition limits construction to
five feet above the pad of the house and that would keep any accessory structure below the
height of the house.

Ms. Michelotti also wanted the school condition applied, even though it was not
applicable because of the timing of construction. She wanted consistency. She also wanted
the narrowest and most rural looking road for the project.

Mayor Tarver encouraged any necessary changes to the agriculture policy that
would meet the concerns of those residents unconditionally opposed to annexation.
However, he felt it was clear that the intent is to maintain the agriculture uses and right to
farm in the area.

Ms. Ayala felt if the City policy is the same as what is allowed by the County, the
residents should be comfortable.

Ms. Dennis felt there was a concern that Code Enforcement officers would come out
uninvited. That does not happen. They only go out in response to a complaint.

Mayor Tarver referred to the Memorandum of Understanding and believed the staff
had worked hard to get agreement with the core property owners and he did not want to
jeopardize that agreement for the sake of the golf course. He was disappointed that the
developer was unwilling to assist in the financing of that process. If the costs go up too
much, that will kill the project as much as a no vote on annexation. The City has invested
millions of dollars that will increase the value of the lots that are there, whether half acre or
10,000 sq. ft., yet there is no cooperation for splitting the differences in terms of the
additional $1.1 million plus $660,000 cash payment, etc. He believed that when you look at
the numbers, the deal is extremely nice for the property owners.

Pleasanton City Council 30 07/29/99
Special Meeting
