p. Accept the Traffic Committee Minutes for July 1, 1999. (IR99:35)

The roll call vote was as follows:
AYES: Councilmembers- Ayala, Michelotti, and Pico.
NOES: None.
ABSENT: Councilmember Dennis and Mayor Tarver.
ABSTAIN: None.

Michael Roush recapped the outcome of the litigation concerning Measure P. He said the
property owners and the developer brought a lawsuit against the City asking the court to set aside
the voters decision. The trial court in Alameda County ruled in the City's favor finding that
there were no grounds to grant the petition to set aside the voters decision. The court will issue a
statement of decision in a few days in which the City will have the benefit of the court's
reasoning.

Ms. Michelotti understood the referendum changed the designation of the property to
unincorporated.

Mr. Roush said the property is unincorporated. The argument is whether the property had
a prior designation. The City argued that the property did not have a pre-zoning or zoning
designation. The word unincorporated is simply a label that was in the zoning map so that the
public would know the property was not within the City limits. The City's argument was there
was no prior zoning designation. The General Plan designates the property as residential. The
City's argument is that nothing precludes the property from being developed as residential. The
outcome of Measure P simply rejected the particular plan that had been approved by the City
Council.

5. MEETING OPEN TO THE PUBLIC

The City Council recognized Pacific Bell for being in business in Pleasanton over 25
years and presented George Granger with a framed copy of the newspaper ad announcing its
anniversary.

Mr. Granger appreciated the recognition and looked forward to a long relationship with
the City of Pleasanton.

The City Council recognized the Hacienda Business Park and PeopleSoff for winning the
American Lung Association Award and presented representatives from each company with a
plaque.

Pleasanton City Council 4 08/03/99
Minutes
