p. Accept the Traffic Committee Minutes for July 1, 1999. (IR99:35) <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers- Ayala, Michelotti, and Pico. <br />NOES: None. <br />ABSENT: Councilmember Dennis and Mayor Tarver. <br />ABSTAIN: None. <br /> <br /> Michael Roush recapped the outcome of the litigation concerning Measure P. He said the <br />property owners and the developer brought a lawsuit against the City asking the court to set aside <br />the voters decision. The trial court in Alameda County ruled in the City's favor finding that <br />there were no grounds to grant the petition to set aside the voters decision. The court will issue a <br />statement of decision in a few days in which the City will have the benefit of the court's <br />reasoning. <br /> <br /> Ms. Michelotti understood the referendum changed the designation of the property to <br />unincorporated. <br /> <br /> Mr. Roush said the property is unincorporated. The argument is whether the property had <br />a prior designation. The City argued that the property did not have a pre-zoning or zoning <br />designation. The word unincorporated is simply a label that was in the zoning map so that the <br />public would know the property was not within the City limits. The City's argument was there <br />was no prior zoning designation. The General Plan designates the property as residential. The <br />City's argument is that nothing precludes the property from being developed as residential. The <br />outcome of Measure P simply rejected the particular plan that had been approved by the City <br />Council. <br /> <br />5. MEETING OPEN TO THE PUBLIC <br /> <br /> The City Council recognized Pacific Bell for being in business in Pleasanton over 25 <br />years and presented George Granger with a framed copy of the newspaper ad announcing its <br />anniversary. <br /> <br /> Mr. Granger appreciated the recognition and looked forward to a long relationship with <br />the City of Pleasanton. <br /> <br /> The City Council recognized the Hacienda Business Park and PeopleSoff for winning the <br />American Lung Association Award and presented representatives from each company with a <br />plaque. <br /> <br />Pleasanton City Council 4 08/03/99 <br />Minutes <br /> <br /> <br />
