Mr. Swift said the Specific Plan requires that when a property is subdivided, that <br />the agricultural use of the property ceases. However, the Specific Plan allows the <br />keeping of agricultural animals in the open space areas of the Specific Plan with a <br />conditional use pennit, and a portion of the Jardin property is open space. Staff has <br />merely copied the requirements of the Specific Plan in Condition #3 of this application. <br /> <br /> Frank Jardin, 751 Clara Lane, indicated he supported the plan and felt it would be <br />a benefit to the community. <br /> <br /> Mary Roberts, 1666 Vineyard Avenue, indicated her primary concern was that <br />Council stick to the Specific Plan which was just adopted. She did not believe anything <br />should be approved until the Financing Plan for the area is approved. She was also <br />concerned because the Jardins were getting rights to the open space property and the <br />other property owners with open space were having their property assigned to a <br />homeowners association. She felt the Jardin property was too small to have horses. The <br />Specific Plan requires 1.5 acres per horse or cow. <br /> <br /> Felicia Scott, 1060 Bartlett Place, spoke in favor of the McGuire project. She <br />known Mr. McGuire for a number of years and he has given many hours of his time to <br />the youth of the community. He has spent nine years on this project and has had many <br />delays. She felt Council was playing politics with a number of small projects. She urged <br />Council to approve these projects because they will be good for Pleasanton. <br /> <br /> Phil Rowe indicated the Finance Plan will be before Council at its next meeting. <br />He understands that will have to be approved along with the second reading of the <br />ordinances for this project before the tentative map application can be deemed complete. <br />He has seen what fees will be applicable to his project and he is agreeable. <br /> <br /> There being no further testimony, the public hearing was closed. <br /> <br /> Ms. Ayala asked why the Finance Plan was not before Council at the same time as <br />these applications. She wants the Vineyard Avenue road alignment and a way for <br />children to get to the school. There are 27 houses going in here and she wants a school <br />for the children to attend. How do we get it? <br /> <br /> Mr. Swift said those are questions the Finance Plan will answer. Staff is drafting <br />a plan that will be circulated among the property owners most affected. However, with <br />the uncertainty of the CAPP Initiative, it is unlikely the Finance Plan will create a <br />mechanism to construct that road in advance of the development along it. It is not <br />possible given the uncertainty in the area. The Fiancde Plan that is being drafted will take <br />the rules of the Specific Plan and expand them to make certain every property owner <br />knows the obligations, requirements for development; what happens if costs have to be <br />advanced for. construction of improvements, how reimbursement will be handled, etc. <br />Council required the Finance Plan before any tentative map, not before a PUD plan <br />approval. <br /> <br /> 24 09/20/99 <br />Pleasanton City Council <br />Minutes <br /> <br /> <br />
