Item 6c <br />Vineyard Corridor Applications (SR:99:278) <br />(1) PUD-99-06, Brian McGuire <br /> Application for Planned Unit Development approval to subdivide 7.37 acres <br /> into a nine-lot residential development <br />(2) PUD-99-10, Robert and Sandra Lutz <br /> Application for Planned Unit Development approval to subdivide 2.51 acres <br /> into a four-lot residential development <br />(3) PUD-99-09, Clara Nevis <br /> Application for Planned Unit Development approval to subdivide 7.34 acres <br /> into a seven-lot residential development <br />(4) PUD-99-08, Kenneth Gooch <br /> Application for Planned Unit Development approval to subdivide 2.75 acres <br /> into a four-lot residential development <br />(5) PUD-99-12, Frank and Lillian Jardin <br /> Application for Planned Unit Development approval to subdivide 2.66 acres <br /> into a three-lot residential development. <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Mr. Pico inquired about the time of these approvals in relation to the CAPP <br />Initiative. He clarified that to obtain vesting, the property owners need to have approval <br />of the PUD development, adoption of a finance plan and the submittal of a vesting <br />tentative map application prior to November 2. He understood that the CAPP Initiative <br />would not be effective until ten days after the election date and asked how that affected <br />the tentative map application. <br /> <br /> Mr. Roush indicated the tentative map application would not be deemed complete <br />until after the second reading of the PUD ordinance and the adoption of the finance plan <br />for the Vineyard Avenue Corridor. Therefore, assuming the ordinance were introduced at <br />this meeting, the second reading could occur on October 5. Assuming the finance plan <br />were adopted on October 5, then there would be almost a month in which to complete the <br />tentative map application and therefore vest these entitlements before the November <br />election. <br /> <br /> Mr. Pico asked if there were any conflicts of interest of Councilmembers such as <br />were present in consideration of the Specific Plan. <br /> <br /> Mr. Roush said the Specific Plan area touched within 300 feet of Councilmember <br />Dennis' residence. These applications do not and there is no conflict of interest. <br /> <br /> Phil Rowe, Delco Builders & Developers, 2552 Stanwell Drive, Suite 203, <br />Concord, indicated this plan is consistent with the Vineyard Avenue Corridor Specific <br />Plan. He also indicated that in addition to the normal school fees, park fees, etc. this <br />project will also pay $730,000.
