It was moved by Ms. Ayala, seconded by Ms. Michelotti, to adopt Resolution No. 99- <br />018, approving the application of Red Bear, Inc., for Design Review approval, as filed under <br />Case Z-98-296, extending the construction hours during the finishing phase and modifying <br />the grill work on the parking level. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, and Mayor Tarver. <br />NOES: None. <br />ABSENT: None. <br />ABSTAIN: Councilmembers Pico. <br /> <br /> Mayor Tarver indicated he would like extensive landscaping done along the parking garage <br />side. <br /> <br />Item 6b <br />Referendum petition concerning the Merritt Property project and alternatives for Council to <br />consider. (SR99:54) <br /> <br /> Michael Roush presented the staff report. <br /> <br /> Mr. Pico asked if there was an option to put this item on the November 1999 ballot. <br /> <br /> Mr. Roush said the election code states the election must be within 88 to 103 days, so the <br />election of choice would be in June. <br /> <br /> Mayor Tarver asked for public testimony. <br /> <br /> Jack Dove, 3263 Vineyard Avenue, had concerns that all projects over a designated amount <br />of units would be subject to voter approval, how much a special election would cost and the impact <br />this referendum would have on the plan for the City. He said the General Plan designates how a <br />piece of property can be developed. Developers go through the process, which may take years, <br />only to be stopped at the eleventh hour by a referendum. He reiterated what happened with the <br />Ponderosa project. He did not appreciate the namecalling or finger pointing. The Council was <br />voted in to make the tough decisions and urged Council to do its job. <br /> <br /> Mayor Tarver asked the audience to keep their comments to whether the referendum should <br />go to ballot or be rescinded. He said there will be plenty of time to debate the other issue. <br /> <br /> Jim Summers, Desilva Group, PO Box 2922, Dublin, said he takes in-fill projects very <br />seriously.
