MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL August 23, 1994 1. CALL TO ORDER Mayor Ben Tarver called the Special Meeting of the City Council to order at 6:45 P.M. 2. ROLL CALL City Manager Deborah Acosta called the roll, which is recorded as follows: Councilmembers Rebecca L. Dennis, Karin Mohr, Thomas P. Pico Jr., Dorothy N. Scribner, and Mayor Ben C. Tarvet. Staff members present were Deborah Acosta, City Manager. 3. Second Amendment to Roadway Improvements Agreement between Alameda County, the Surplus Property_ Authority of Alameda County, the City of Pleasanton, and the City of Dublin. Ms. Acosta briefly reviewed the proposed amendment to the agreement. After numerous settlement discussions in the last several months, Council, on August 16, 1994, approved a settlement agreement with Dublin. This amendment to the Roadway Improvement Agreement was one of the exhibits which needs to be formally approved. The amendments to the Roadway Improvement Agreement include reducing Dublin's total cost of the construction of the roadway by $400,000, and removing Dublin's obligation to use its general fund for the repayment of the debt. Mr. Tarver stated that Dublin has also approved the settlement agreement and has approved this Amendment to Roadway Improvement Agreement. After the County approved the Amendments, the lawsuit will be resolved. SharreH Michelotti, 7873 Olive Court, requested clarification of various aspects of the agreement. Ms. Acosta explained that generally the terms are the same as before. As Dublin forms assessment districts, payments will be made to Pleasanton, which will use the funds to reduce the North Pleasanton Improvement District bonds. She also indicated that these funds were never to be used by Pleasanton's general fund. 08/23/94 1
