He further explained that the area <br />would be used for his equipment, but not as a storage area for materials. The house which sits <br />in front of the business site will be rented in order to let the residential effect remain. He added <br />that he does not use and would not store pesticides at the site. <br /> <br /> Leah Jones, P.O. Box 262, reiterated that the site would not be used as a storage site; <br />rather it would be used as a temporary parking area for vehicles. She named the types of <br />equipment that would be used at the site (i.e. brooms, rakes, etc.). She did not want to appear <br />as if she and the applicant were changing plans frequently, but as Mr. Grimes stated, they were <br />just trying to accommodate staffs recommendations. Ms. Jones further explained that the office <br />area would be used as a meeting room for safety meetings and the garage would be used for <br />demonstrations of equipment. Ms. Jones thanked staff for its time and efforts and again <br />apologized for misleading people by the "storage" description. <br /> <br /> In response to Council's questions, Mr. Grimes reiterated that he would not be storing <br />pesticicles and that the driveway would be paved. There would be no noise impact on the <br />residents in the area. If downtown were to grow and prosper enough that his business would <br />no longer be suitable for the area he would be willing to sell move the business. <br /> <br /> There being no further testimony, Mr. Tarver declared the public hearing closed. <br /> <br /> Council shared the concern of approving this as a conditional use permit because later, <br />if the time came that the business no longer "fit" in with the surrounding uses, it would need <br />to move. <br /> <br /> Mr. Pico and Ms. Dennis were concerned with setting a precedent for other businesses <br />to apply for such a permit. <br /> <br /> It was moved by Mr. Pico, and seconded by Ms. Scribner, upholding the appeal of the <br />Planning Commission, thereby finding that the use was not a conditionally permitted use in this <br />zoning district. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Dennis, Pico and Scribner <br />NOES: Councilmember Mohr and Mayor Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br />COntinuation of Item 7a <br />PUD-85-15-4M, R0nald C.
