Box 520 <br />Pleasanton, CA 94566 <br /> <br /> BERNAL AVENUE EXTENSION AGREEMENT <br /> <br /> THIS AGREEMENT is entered into this 16th day of February, <br />1988 by and between the CITY OF PLEASANTON, a municipal <br />corporation (hereinafter referred to as "City") and FRANK AUF DER <br />MAUR and KONRAD RICKENBACH (hereinafter referred to as "Owners"). <br /> <br /> RECITALS <br /> <br /> A. Frank Auf der Maur and Konrad Rickenbach own a parcel of <br />land within the city limits of Pleasanton in the vicinity of the <br />Valley Avenue Extension (APN 946-1250-40-3) consisting of <br />approximately 30.05 acres (hereinafter referred to as "Auf der <br />Maur Parcel"). <br /> <br /> B. The City has long planned an extension of Bernal Avenue <br />through the Auf der Maur Parcel. Owners plan to develop the Auf <br />der Maur Parcel in commercial uses. <br /> <br /> C. Owners entered into an agreement with the City (the <br />Valley Avenue Extension Agreement dated May 20, 1986) in <br />contemplation of development of a portion of the Auf der Maur <br />Parcel as a shopping center. The proposed shopping center failed <br />to receive zoning approval and some of the terms of the earlier <br />agreement are no longer relevant. <br /> <br /> D. On July 12, 1983, Owners entered into an agreement with <br />the City to permit the City to construct a portion of Bernal <br /> <br /> - 1 - <br /> <br /> <br />
