However, he has been directed by AT&T to indicate to the Council that it would not oppose the
$100 per employee figure that has been proposed by staff.

Barbara Allen, Pleasanton Chamber of Commerce, encouraged the Council, staff and
developers to reach an agreement as soon as possible on the condition requiring the business
park developers to mitigate the recreation impacts on the City' s park system.

Jim Gresham, Parkway Properties, 7011 Koll Center Parkway, representing Bernal
Corporate Park, indicated Parkway Properties is willing to support the consensus position, but
more importantly, he agrees with Mayor Tarver's position for reconsideration of the item. He
feels it is unfair that there was only a certain window in which business developments were
imposed with this condition.

There were no other speakers.

Mayor Tarvet stated that he would like the Council to consider a higher fee of
$159/employee.

It was moved by Ms. Michelotti, seconded by Mr. Pico, to adopt the consensus
amount of $100 per employee.

Ms. Dennis commented that this has been her position all along. The condition was
imposed because Pieton was taking on a new direction in its economic basis - a vision of
wanting to attract large employers to the city. She would like to go forward with that vision.
She feels it was an important step for the large employers for the Council to move in that
direction as well as to treat future large development in the same way. Ms. Dennis also believes
it is very important that the City have large employers making contributions to develop the City
as a place where other large employers would choose to locate.

ROLL CALL
AYES: Councilmembers Dennis, Michelotti, Pico and Mayor Tarver
NOES: None
ABSENT: Councilmember Mohr
ABSTAIN: None

Ms. Micheloff inquired how the businesses caught in the middle would be treated.

Mr. Pico feels that they have agreed to a condition, and if an agreement is made, they
should honor the agreement. He would, however, agree to discuss whether the Providian
condition should be applied to the entire complex or only the third building.

Ms. Micheloff advised she would not agree to applying the fee to Providian because she
feels that if the park obligation fee went forward, every business would be taxed. She would
like to have these 'caught' businesses have a final determination after reconsideration.

12/11/95 - 12 - City Council Minutes
