Spiliotopolis Questions/Clarification

Mr. Swift stated the Planning Commission reviewed the application for the conditional
use permit at the former Cheese Factory. The issue was the design, operation and activities that
would take place in the current parking area, since a portion of the parking lot has access over
one of the adjoining parcels through an easement on the Spiliotopolis property. Mr. Swift stated
that the Planning Commission had reconciled the gate issue and it has been incorporated into the
project but is not shown as an express condition of approval because it was made a part of the
application. The second issue is an old foundation that exists in the area that the driveway goes
between the Cheese Factory and Spiliotopolis property that tends to make cars not stay within
the easement but go on to the Spiliotopolis property. Rather than have Council appeal the
project, Mr. Swift suggested that staff work with Mr. Spiliotopolis and the owner of the property
of the Cheese Factory to see if those issues can't be reconciled. If not, staff can bring it before
City Council as an appeal.

Mr. Spioliotopolis agreed to try and work this out with staff.

Item 6f
Amendment to the Happy Valley Area Golf Course Reimbursement Agreement with MJM
Partners to fund consultant services and authorization to expend additional money for
further studies. (SR95:344)

Sue Rossi presented the staff report.

Mayor Tarver stated that the applicant has spent $35,000 of his money, the issue is
getting further out and the Council has not come to any decision. He stated the City will pick
up half of the cost for a financial advisor so that the issue will get it to a point where something
can be brought before the Planning Commission, Council and the community.

It was moved by Ms. Mohr and seconded by Ms. Dennis, to authorize staff to spend up
to $15,000 for professional services in connection with the City's potential participation in the
golf course project; and authorize staff to amend the reimbursement agreement with MJM
Partners to include reimbursement to the City of up to $35,614 for costs incurred to contract a
feasibility study, appraisal and financial advisory services related to the Happy Valley Area golf
course project.

The roll call vote was as follows:
AYES: Councilmembers Dennis, Michelotti, Mohr, Pico, and Mayor Tarvet
NOES: None
ABSENT: None
ABSTAIN: None

10/17/95 -20-
