conflicts created by the operation due to parking, noise, odors, traffic or other factors. Staff felt
that if a unique problem occurred at a particular location/site, the City has the ability to add
additional conditions. The ability to disallow the business, however, is not available, which is
available under the regular condifioned use permit process. Staff felt the breweries would work
like a retail store rather than a bar.

Ms. Michelotti asked if permitted uses are noticed to the public.

Mr. Swift stated replied there is no notice if it is a permitted use.

Mayor Tarver stated when someone puts a microbrewery in a neighborhood the
neighborhood should have a chance to respond.

Mr. Swift stated that CN zones would not allow microbreweries under the code change
that was proposed. In downtown and larger shopping centers in business parks, they would be
permitted uses.

Mayor Tarver asked where the CR, CC or CS districts are in relationship to
neighborhoods?

Mr. Swift stated in a rear yard setting. All the shopping centers on the east side of
Hopyard Road would allow this use.

A substitute motion was made by Mayor Tarver, and seconded by Ms. Dennis, that
Ordinance No. 1662 be introduced, to be read by title only and waiving further reading thereof,
to amend the Pleasanton Municipal Code, except that microbreweries would be a conditionally
permitted use rather than a permitted use.

The roll call vote was as follows:
AYES: Councilmembers Dennis, Pico, and Mayor Tarver
NOES: Councilmembers Michelotti and Mohr
ABSENT: None
ABSTAIN: None

Item 6e
ASSessments within the Moller Ranch (Tract 6618) Geologic Hazard Abatement District
(GHAD) and ordering levy and collection. (SR95:314)

Mayor Tarver adjourned the City Council meeting and called to order the Board of
Directors for the Moller Ranch GHAD.

Randall Lure presented the staff report.

09/19/95 -9-
