Ms. Mohr questioned if an opportunity exists for future homeowners to protest? What <br /> would be the basis of this protest? <br /> <br /> Mr. Lum replied that the homeowners can protest any or all issues on how the City is <br /> administering the GHAD, as to the level of service, the appropriateness, and the cost of service. <br /> <br /> Mr. Pico asked if this were on an annum basis? <br /> <br /> Mr. Lum replied yes. <br /> <br /> Mayor Tarvet asked if the homeowners don't get what they are asking for when the <br /> protest is made, what would be the result of that to the City. <br /> <br /> Mr. Roush replied that the protests have to be considered and if the protests were <br /> warranted, Council would take appropriate action. If Council didn't feel the protests were <br /> warranted, Council would have to overrule the protests and confirm the assessments or what <br /> assessments it felt was appropriate. <br /> <br /> Ms. Mohr questioned if the homeowners wanted to take control of the GHAD as a <br /> homeowners association, could they be given that opportunity. <br /> <br /> Mr. Lum stated it is an option under the GHAD legislation. The homeowners can form <br /> a Board of Directors and Council can choose to have the Board of Directors administer the <br /> GHAD. <br /> <br /> Mayor Tarver opened the public hearing. <br /> <br /> There being no speakers, the public heating was closed. <br /> <br /> It was moved by Ms. Michelotti, and seconded by Ms. Mohr, that Resolution No. 95-107, <br /> be adopted, ordering the cost and expenses of maintenance and operating an improvement be <br /> assessed against the property; confirming the assessments and ordering the amount of <br /> assessments levied against each parcel of property; and directing the Clerk of the District to <br /> record a notice of assessments. <br /> <br /> The roll call vote was as follows: <br /> AYES: Boardmembers Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Mayor Tarver adjourned the Moller Ranch GHAD meeting and reconvened the City <br />-- Council meeting. <br /> <br /> 09/19/95 -10- <br /> <br /> <br />
