Mayor Tarver opened the public hearing.

Michael Kliment, 5142 Foothill Road, agreed with staff recommendations.

Mayor Tarver asked if there was a particular reason that the R-I-40,000 is preferred over
PUD zoning.

Mr. Kliment was told the PUD zoning was not appropriate because the nature of his
property does not lend itself to any future development because there is no other access to his
property. Under the PUD, if any other improvements are to be made to the property, he would
have to go through a formal procedure and submit an application to remodel the house or add
any out structures.

There being no further speakers, the Mayor closed the public hearing.

It was moved by Ms. Dennis, seconded by Ms. Mohr, that Ordinance No. 1661 be
introduced, approving the application to rezone the parcel at 5142 Foothill Road from
Agricultural and PUD to R-I-40,000.

The roll Call vote was as follows:
AYES: Councilmembers Dennis, Michelotti, Mohr, Pico and Mayor Tarvet
NOES: None
ABSENT: None
ABSTAIN: None

Item 6f
PUD-91-19-2M - Jerrell and Vicki Thomas
Minor modification to PUD-91-19-1M to extend the September 1, 1995 expiration date for
the development plan approval to November 12, 1995. The development plan includes the
construction of a single-family home on a 1.25 acre site located at 5226 Foothill Road.
Zoning for the property is PUD (Planned Unit Development) - Low Density Residential
District. (IR95:49)

Brian Swift presented the staff report.

Mayor Tarver asked if items that are routine in nature or informational can be put on the
consent calendar in the future. Council can pull them off if it needs to discuss the item, rather
than have a full presentation by staff.

No action was required or taken on this item.

09/05/95 -14-
