It was moved by Ms. Dennis, and seconded by Mr. Pico, that alternative #4 (a two foot <br /> wide cobblestone island from Independence Drive to 190 feet east of Mirador Drive) be <br /> approved with restriping at the end of the barrier to indicate left turns are prohibited; to direct <br /> staff to communicate with Shapell that the preferred route for heavy truck traffic is a fight turn <br /> to Mirador off Bernal; and to approve the use of gas tax funds to build the barrier. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Dennis, Pico, and Mayor Tarver <br /> NOES: Councilmember Michelotti and Mohr <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 5b <br /> ACCeptance of public improvements for Tract 6483 and Tract 6518, Bonde Ranch, Shapell <br /> Industries (SR95:279) <br /> <br /> Ms. Dennis asked if anything had changed from the previous meeting where 90% of the <br /> bond was to be returned to Shapell. She asked if the street could still be closed until the barrier <br /> was installed. <br /> <br /> Mr. Roush stated that staff was recommending to keep the street closed until the barrier <br />-- is constructed but to accept the public improvements for Tract 6483 and Tract 6518, Bende <br /> Ranch. <br /> <br /> Mayor Tarver indicated there were problems doing that with another development and <br /> the City was forced to remove the barrier. <br /> <br /> Mr. Roush stated there have been situations where homes are under construction and the <br /> barriers are left up (although the roads are public) because there is no public demand to use <br /> those streets. There has been a demand that this street be opened. If the City were compelled, <br /> it would have to open the street up. <br /> <br /> Ms. Dennis asked if this was acceptable with the developer. <br /> <br /> Mr. Roush replied the problem the developer has run into is that if the public <br /> improvements are not accepted, other parts of its project are being used that extends the time <br /> for its one year maintenance period. Shapell is interested in getting the one year maintenance <br /> period to begin, which happens when the public improvements are accepted. Even though the <br /> bonds were reduced to 10%, that doesn't start the one year maintenance period. <br /> <br /> Ms. Dennis asked if it were acceptable to the developer to have the street closed while <br /> building the barrier. <br /> <br /> 08/22/95 -6- <br /> <br /> <br />
