6, MATTERS INITIATED BY COUNCIL <br /> <br /> Ms. Michelotti appreciated the staffs response and Buster McCurtain's response to the <br />red roof at Foothill High School. There was a mistake in the color used and the School District <br />was withholding payment to the contractor until they could resolve the color and get it repainted. <br />If anyone is interested in giving input on which color the roof might be painted, contact Buster <br />McCurtain. <br /> <br /> Mayor Tarver requested forming a Council subcommittee to have meetings with Zone <br />7 on water issues involving various areas such as San Francisco property, Dougherty Valley, <br />etc. <br /> <br />7. CLOSED SESSION <br /> <br /> Council adjourned to Closed Session at 11:26 p.m. to confer with Deborah Acosta <br />regarding the Management Compensation Program. Council also conferred with legal counsel <br />regarding pending litigation, Save Our Sunol v. Alameda County and Town of Danville v, <br />Contra Costa County (Dougherty Valley litigation) <br /> <br /> Following the Closed Session, the City Council reconvened in open meeting. It was <br />moved by Ms. Dennis, seconded by Mr. Pico, to approve filing an amicus brief in the Save Our <br />Sunol v, Alameda County matter. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Pico, and Mayor Tarvet <br />NOES: Councilmembers - Michelotti and Mohr <br />ABSENT: None <br />ABSTAIN: None <br /> <br />10.
