inspections were being done; and if the report were inadequate or the Association did not <br />respond, then the CC&Rs gives the City the right to undertake the work and make sure the work <br />gets done in an adequate fashion. <br /> <br /> Mr. Pico stated that he felt the disclosure statement was weak and cited some examples. <br />He stated that the nature of the disclosure statement skirts around the issues of the geologic <br />review, and it suggests that anyone reading the disclosure statement obtain a memorandum from <br />the City Planning Director to the City Manager dated May 2, 1994. He stated that anyone that <br />asks for a disclosure from the City should be provided the May 2nd report and all copies of the <br />City Council minutes and reports and agenda items that have subsequently been <br />reviewed/presented, including the testimony from the homeowners and information from <br />Councilmembers. He felt that it was inadequate to give a partial disclosure and not attempt to <br />fully disclose the hazards that exist. <br /> <br /> Ms. Michelotti asked if the comprehensive staff report referred to is the one that the <br />Council had at the meeting when this issue was first addressed. <br /> <br /> Mr. Roush stated that the referenced report dated May 2, 1994 is fai~y comprehensive <br />in terms of what had happened to that point. He stated there are other parts to the disclosure <br />that talks about other information available for review and it was staff's intent to include the <br />things that Mr. Pico referred to. These items are available for review at City Hall. <br /> <br /> Ms. Mohr asked about the number of documents, including Council meetings minutes <br />and other information about this project. <br /> <br /> Ms. Dennis stated that the information would have to be organized and accessible for <br />people to find what they are looking for. She felt that it is important for the homeowner or <br />potential homeowner to be familiar with the property and the kind of responsibility that comes <br />with living there and why it is important for them to understand as much as possible as to what <br />is happening on the site. <br /> <br /> Ms. Michelotti suggested that a file be available for the public to read or request copies <br />of specific documents rather than have mounds of reports on hand. She thought that handing <br />over massive documents would be overwhelming. <br /> <br /> Ms. Mohr talked about the frequency of inspections of the site. She thought the key to <br />inspection frequency should be inches of rainfail. She asked if and how that could be done. <br /> <br /> Mr. Lum suggested that there could be a way to tie the need for inspections to abnormal <br />rainfall and the language of the program could be modified to say that. <br /> <br /> Ms. Michelotti asked if the condition could be left as is but with the understanding that <br />abnormal rainfall would automatically trigger an inspection. <br /> <br />06/06/95 9 <br /> <br /> <br />
