He felt that it <br /> could be added. <br /> <br /> Ms. Mohr asked for clarification. <br /> <br /> Mr. Roush stated that Mr. Pico's request is that during the time the improvement work <br /> is going on, there would be someone on site to view and observe what was being opened up to <br /> make sure that what everyone thinks is there, is in fact really there. <br /> <br /> Bruce Stringer, 2047 Valley Oak Road, thanked Deborah Acosta, Karin Mohr, Becky <br /> Dennis and Michael Roush for their efforts. He stated it is a standard procedure when any <br /> construction takes place at Golden Eagle, that there is a soils engineer or licensed geologist on <br /> the site to inspect cuts and compaction. <br /> <br /> Margaret Tracy, 1262 Madison Avenue, felt that the geologic assurance program will not <br /> protect the public interest of the City and Valley residents. She felt that there is a need for <br /> independent consultants and fees set according to the needs for repairs as recommended by the <br /> consultants. She felt there needs to be some guarantee that the mitigation and recommendations <br /> will be implemented and monitored and also asked if there were a timeline to have the requests <br />_ completed. She felt that these repairs will be done only if they are in the CC&R's budget. She <br /> asked if there are penalties for noncompliance or delays. She felt it would be helpful to have <br /> a map showing the properties that are included. She felt that unique needs might arise and <br /> questioned how the Association will handle them since it is a private entity. <br /> <br /> Ms. Dennis asked how the Council can be sure the abatement happens and what <br /> safeguards are there for the City. <br /> <br /> Mr. Roush stated that the Association has agreed that the budgetary limitation language <br /> in the exhibits be eliminated. This proposed amendment to the CC&R's will be sent to the <br /> homeowners and will put them on notice that there are certain rules and regulations that have <br /> to be looked at and followed. Any work that would be done would be reviewed by the <br /> Association as well as by the City and if work is going on without approval, there are methods <br /> to stop work until those permits are obtained. <br /> <br /> Ms. Michelotti asked if the City determines if the rules and regulations apply and would <br /> enforce them through our normal inspection process. <br /> <br /> Mr. Roush stated that this is correct. Through the inspection process, the City would <br /> insure that the appropriate rules and regulations were followed. He also stated that the annual <br /> report is paid by the homeowners association, not the City. It will be reviewed by the Public <br /> Works Director and circulated to our geo-technical consultants to look at, to make sure certain <br /> <br /> 06/06/95 8 <br /> <br /> <br />
