(SR95: 147) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Ms. Mohr asked if the painted signs on the building conform to the Hacienda CC&Rs. <br /> Mr. Swift answered yes. <br /> <br /> Mr. Fred Divine, architect for this project, 1930 Fourth St., San Rafael, stated this <br /> application includes items that Chevys sought: 1) improved parking, 2) extra seating in the <br /> building and 3) approval of an illuminated sign. He stated that the sign program (the monument <br /> sign and three building signs) submitted is not outside the guidelines that are allowed by the <br /> Hacienda Association. They will even reduce the size of the sign even though they thought they <br /> were in compliance. Mr. Divine did not realize the time it took to process a major modification <br /> to a PUD and asked that the Council allow them to reach an agreement with the City Attorney's <br />- office to allow the construction for the parking lot to proceed prior to July 6th which is the <br /> approximate date the ordinance takes effect. <br /> <br /> Mayor Tarver asked if the applicants were willing to take out the parking improvement <br /> if there are any problems later if the Council lets them proceed. <br /> <br /> Mr. Divine stated that could be worked out since Chevys already has the lease, and the <br /> development under the existing PUD isn't going to happen because Chevys now has control of <br /> that property. Another restaurant could not be built on that other property and a major <br /> modification would have to be approved before any parking solution could be approved. <br /> <br /> Ed Owing, Director of Construction for Chevys, 1855 Vancouver Way, Livermore, <br /> stated this project was originally done under a variance which provided Chevys would have to <br /> increase the parking at a later date.
