Ms. Mohr asked for a response from the City Attorney about staffs position not to <br />remove the ordinance. <br /> <br /> Mr. Roush indicated Council can initiate an amendment to review the code. He <br />recommended the matter be referred to the Park and Recreation Commission for <br />recommendation on a) whether to eliminate that section of the ordinance, b) amend it in certain <br />ways to reduce the credit or eliminate the public interest aspect of it and/or c) to clarify the <br />standards. <br /> <br /> Mr. Tarver did not believe there was any guidance in the ordinance about standards for <br />the credit. He wanted clarification to take out any ambiguities and wanted further public <br />dialogue. <br /> <br /> Ms. Michelotti suggested long range considerations. As future budget problems may <br />continue to occur, she suggested requiting private developments to provide parks for the areas <br />and to maintain them. She was willing to review the ordinance, but urged Council not to be so <br />narrow in its approach. <br /> <br /> Mr. Tarver believed that is a possibility that could be imposed at Council's discretion. <br />In the case of Ruby Hill, there was no discretion. <br /> <br /> Ms. Acosta indicated staff recommended the credit because the park exceeded the <br />standards, not just met them. <br /> <br /> It was moved by Mayor Tarver, seconded by Mr. Pico, to refer the ordinance to the Park <br />and Recreation Commission to review the provision regarding credit for private park space. <br />Th~ roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> There was a break at 9:47 p.m. <br /> <br /> The meeting was reconvened at 9:55 p.m. <br /> <br />04/04/95 -16- <br /> <br /> <br />
