It was moved by Ms. Dennis, seconded by Ms. Mohr, to approve the staff <br />recommendation to place a skateboard track in the southwest corner of the Pleasanton <br />Sports Park. <br />The roll call vote was as follows: <br />AYES: Councihnembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />6. MATTERS CONTINUED FOR DECISION <br /> <br />Item 6a. <br />Status of Golden Eagle Farin Geologic Review (Continued from 1/17/95 and 2/7/95) <br />(SR 95:40) <br /> <br /> Michael Roush presented the staff report. <br /> <br /> Wilson Wendt, One Kaiser Plaza, Oakland, attorney for the Golden Eagle <br />Homeowners Association, indicated he has been trying to settle this dispute for the last <br />month. He stated that none of the lot owners, nor the Association, were responsible for <br />doing any of the geological analysis or review for the City. That was done prior to the <br />subdivision maps being recorded. The maps are recorded and all the lots have been sold. <br />Obviously, Council has the authority to change the situation if there is a question of <br />health or safety. He did not believe there was any evidence for Council's action, except <br />for a controversial geologist. The geologist's work has been checked, rechecked and <br />double-rechecked. He has conferred with other jurisdictions where Mr. Levish worked <br />and there has been no similar problem. He believed the issue was raised by Council and <br />it is now causing considerable problems for the residents in Golden Eagle because a <br />stigma has been created. There are now problems with financing and selling the houses. <br /> <br /> Mr. Wendt reviewed the possibility of a geologic hazard abatement district <br />(CHAD). He has been advised that a CHAD is not economically feasible unless it <br />contains 1500 to 2000 unit. He acknowledged there are advantages to a CHAD, but <br />because there are only eighty lots in Golden Eagle, the homeowners association is <br />opposed to an assessment of over $600 per lot. In addition, the assessment would only <br />provide for operational maintenance and would not build a reserve. He recommended <br />accomplishing the objectives of a GHAD through the existing homeowners association. <br />It has an existing reserve for repair of soil subsidence. Many of the City's concerns are <br />already addressed in the CC&Rs. <br /> <br />03/07/95 - 7 - <br /> <br /> <br />
