Adopt Ordinance No. 1649, approving the application of Ruby Hill Joint <br /> Venture, L.P., a major modification to an approved PUD development <br /> plan, as filed under Case PUD-93-02-1M. <br /> <br /> m. Adopt Ordinance No. 1650, approving a Development Agreement, as <br /> amended, between the City of Pleasanton and the Ruby Hill Development <br /> Joint Venture L.P., regarding the Ruby Hill project. <br /> <br /> n. Adopt Ordinance No. 1651, amending sewer rates and charges. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> 5. MEETING OPEN TO THE PUBLIC <br /> <br /> Jack Line, 5250 Case Avenue, presented pictures of Mayor Tarver in a <br /> conductor's cap and uniform, and expressed his concern about Mr. Tarver being an <br /> honorary member of the Pleasanton Railroad Association. He then referred to statements <br /> by Mr. Churka in the newspaper about the train coming to Pleasanton and the sidewalk <br /> between the Senior Center and Ridge View Commons. He also referred to a letter form <br /> Mr. Churka to the City Council threatening litigation. Mr. Line indicated an <br /> environmental impact report has never been prepared and the question of railroad <br /> crossings has not been addressed. Mr. Line also referred to statements of Mr. Churka <br /> that trains would run every Saturday, Sunday, holiday and for charters. Mr. Line <br /> believed that would be ten or more days a month. He felt that if the measure is put on <br /> a ballot, the wording should include a bond issue. He believed a bond issue would be <br /> necessary if the ISTEA funds were not granted. He stated ISTEA funds are seldom given <br /> to transportation projects the public must pay to use. The Public Utilities Commission <br /> will be required to approve five city crossings. Mr. Line suggested mailing <br /> questionnaires instead of a ballot measure. <br /> <br /> Mr. Line also referred to comments about improving business, but does not recall <br /> comments by any member of the Chamber of Commerce, the Downtown Association or <br /> other organization. He believed most of the businesses open in downtown Pleasanton on <br /> weekends are bars or restat. rants. Most of the riders are juveniles who will not patronize <br /> either type of business. <br /> <br /> 03/07/95 - 4 - <br /> <br /> <br />
