(SR 95:02) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Ms. Michelotti inquired if this project was subject to the requirement to participate in the <br /> funding of the West Las Positas interchange if it is built. <br /> <br /> Mr. Swift indicated it was part of the conditions of the project, and further indicated that <br /> if the interchange is not built, the developer is not required to pay any fee. <br /> <br /> Mr. Pico referred to the traffic report which indicated that if the West Las Positas <br /> interchange is not completed, then Hopyard Road will reach LOS E. He asked if the condition <br /> requiring participation in the West Las Positas interchange overrule the requirement to mitigate <br /> other traffic impacts? <br /> <br /> Mr. Swift explained that there are a number* of dc~uments which include conditions on <br /> this bvsir!ess park, including the Mitigation Measures Agreement which runs with the land. That <br /> agreement requires participation in traffic mitigation measures required to meet LOS D in this <br /> area. There are other mechanisms to control traffic such as the Transportation Systems <br /> Management Program and other City police powers applicable to business in north Pleasanton. <br /> Mr. Swift also indicated that First Deposit is one of the city's best employers in terms of <br /> meeting the requirements of the TSM program. <br /> <br /> Mr. Tarver requested clarification on what mitigations were available if the West Las <br /> Positas interchange is not constructed. He thought that interchange was the only way to meet <br /> the standard. <br /> <br /> Mr. Swift indicated that is based on the assumptions that are in the model. If the level <br />-- of development changes, then the model will change. In addition the Air Quality rules requiring <br /> <br /> 01/03/95 <br /> - 15- <br /> <br /> <br />
