Item 6f (formerly item
PUD-89-17-2M, Curfin Construction Company

Mr. Tarver inquired regarding the status of the property if Council does not allow this
action.

Mr. Swift said the PUD would remain intact for the property and still show the same
lots. The tentative map and conditions of approval described those lots as undevelopable. They
are not part of the permanent open space required of the PUD. Mr. Currin is in the process of
doing geological and technical studies to determine whether the hillside is stable enough to allow
residential development. If these lots are not joined with the other lots, there is a potential that
they could be made into buildable lots.

Mr. Tarver believed if these lots were combined with other lots there would not be any
additional building.

Mr. Swift agreed.

Mr. Tarver asked if there were other lots affected by the studies that are in process?

Mr. Swift stated the studies were being done for those approved in the PUD subject to
subsequent geologic testing on the hillside. If the geologic study determines the lots to be
developable and Council agrees, there will be additional lots added to the subdivision through
the tentative map process, but not these two subject lots.

No action was necessary.

RCm 6e
ReSponSe tO Alameda County Fair Association Management Audit dated September 1996.
(SR96:299)

This item was discussed earlier in the agenda.

7.
