6, PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />Cit_v Policy Regarding Sidewalk Vending. Street Vendinn. Catering Trucks and Other <br />Private Vendors on Private Property, Private Vendors in Cit_v Parks. Vendors Not <br />AuthOrized by the Ple~Santon Downtown Association (PDA) SeHin? Merchandise Durin2 <br />PDA EventS, and Sidewalk Entertainment. (SR96:291) <br /> <br /> Mr. Pico indicated he would not be participating in any discussions regarding the <br />Pleasanton Downtown Association. <br /> <br /> Michael Roush indicated that portion of the staff report (//6) regarding the PDA could <br />be separated and proceeded to present the staff report. <br /> <br /> Ms. Dennis thought the law seems to be written to accommodate the ice cream vendors. <br />She felt there were many parents who had concerns for the safety of their children, who tend <br />to run into the street when they hear the music of the ice cream vendor. <br /> <br /> Mr. Roush explained that the ordinance is written such that a person with a licensed <br />vehicle is allowed to park on the street and dispense food so long as it does not create a traffic <br />problem. <br /> <br /> Ms. Mohr felt the ice cream truck was a novelty for the children and something we have <br />to live with. <br /> <br /> Mr. Tarver indicated he had seen an accident at the Sports Park involving a child running <br />from the ice cream truck and he believed the ice cream trucks are a public safety issue. <br /> <br /> Mr. Roush indicated private vendors are not permitted in the Sports Park, however there <br />is only about five feet of landscaping between the parking lot and the public street, where the <br />activity is permitted. It is possible to enforce the ordinance to prohibit ice cream vendors on <br />the street near the Sports Park. <br /> <br /> Ms. Mohr indicated the nonprofit sports groups use the food vending in the Sports Park <br />as a means of fundraising and private vendors should not be allowed to compete with that. <br /> <br /> Mr. Roush indicated that was one of the rationales for not allowing private vendors <br />within the park facilities, especially the Sports Park. <br /> <br /> Mr. Pico was not interested in prohibiting ice cream trucks. <br /> <br /> Mr. Roush indicated the ordinance was not a total ban, but if Council desired, there <br />could be regulation in certain areas. <br /> <br /> 4 10/01/96 <br /> <br /> <br />
