Ms. Mohr expressed concern about the location and aesthetics of the newsracks curren~y <br /> located on Owens Drive and requested they be moved. She believed there was a traffic hazard <br /> created by people stopping to get newspapers even if it is a no stopping area. She suggested <br /> using the same kind of structure to house newsracks that is used on Main Street and moving the <br /> newsracks to another location. <br /> <br /> Mr. Hirahara indicated officials from Denny's would be willing to discuss this. <br /> <br /> There being no further testimony, the public heating was closed. <br /> <br /> Ms. Dennis asked what happens if there is a problem with the abandonment of Johnson <br /> Court. <br /> <br /> Mr. Swift said the matter will come before Council for a public heating. If the street <br /> is vacated at the north end of Denny's, then its access remains the same as it is today. Staff has <br /> just begun discussions with the property owners to determine the best configuration for the <br /> proposed street. Currently there is no objection to the vacation on the northern boundary. He <br /> aim indicated staff supports Mr. Ten'ill's suggestion to amend Condition #3 to allow <br /> construction on the retail portion of the project before the vacation issues are resolved, since all <br /> construction takes place north of the existing bulb. <br /> <br />" Mr. Tarver did not object to allowing grading to proceed, but did not want the building <br /> to be started until the vacation issue is resolved. <br /> <br /> Mr. Terrill clarified that the interest is to allow the retail project to proceed regardless <br /> of how the cul de sac issue is worked out. All easements are in place and access would be the <br /> same. He agreed the hotel would not proceed until the vacation issue is resolved. <br /> <br /> Ms. Mohr was concerned that seems to give leverage to Denny's in its negotiations. She <br /> supported letting the retail portion proceed and working out the issues regarding the hotel later. <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Mohr, to adopt Resolution No. <br /> 96-103, making a finding of de minimus impact and approving a negative declaration for <br /> the application of Reynolds and Brown as filed under Case PUD-96-13. <br /> <br /> The r011 Call v0t¢ was as follows: <br /> AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Dennis, to direct staff to begin <br />-- street vacation proceedings for Johnson Court. <br /> <br /> 09/10/96 <br /> -7- <br /> <br /> <br />
