Mr. Tarver asked if the agreement addresses if and when the TVTC adopts a regional <br />fee whether the distribution will be re-addressed. <br /> <br /> Mr. Harris advised that is not a part of the agreement. He believes that type of language <br />could be incorporated in the agreement. In response to Mr. Tarver, Mr. Harris advised the <br />environment document is being circulated at this time and will be ~nalized later this fall. <br /> <br /> Mr. Tarver clarified that although the EIR will be certified in September, ACTA would <br />like the local match commitment by October. <br /> <br /> Mr. Harris agreed. <br /> <br /> Ms. Michelotti stated that recent TVTC discussions have centered around that when all <br />fees are established and collected, they will go into a fund. The year 2002 is when the money <br />has to be paid. The money in the fund will be used first for the project. Therefore, the <br />jurisdictions may not have to come up with the full amount now. <br /> <br /> Mr. Pico inquired about the status of the environmental document and whether it is a <br />Negative Declaration. <br /> <br /> Mr. Harris stated that the environmental document currently is a Negative Declaration. <br />The Federal Highway Administration concurs with this level of documentation. <br /> <br /> Mr. Pico inquired if the Negative Declaration format was used in order to keep with the <br />established time line. <br /> <br /> Mr. Harris noted that a Negative Declaration may be somewhat quicker to process than <br />a full EIR/EIS, however, it really depends on the level of mitigations in the project. This is a <br />major project, but it does not have the number of mitigations that another project of this size <br />could have. Overall, this project has very few environmental impacts. In response to Mr. <br />Pieo's question, Mr. Harris advised that the Negative Declaration covers the single leg of the <br />1-580/680 flyover project, not the whole conceptual project. However, the overall interchange <br />project is analyzed in relation to the single leg project. Because there is no financial ability to <br />fund the complete construction, it could not be included in the environmental document. <br /> <br /> Mr. Pico inquired if an EIR or a Negative Declaration was done for the Castro Valley <br />flyover from 238 to 880. <br /> <br /> Mr. Harris stated a full EIR/EIS was done because it was a more extensive project that <br />had significant impacts on fights-of-way, noise, etc. <br /> <br /> Mr. Higdon stated that because no significant environmental issues were brought forward, <br /> full EIR was not triggered.
