issue and not the responsibility of the property owners in the area. It is the responsibility of the <br />City and perhaps the Ruby Hill developers, but not by a property owner that is only peripheral <br />to the road. The actual effect will be detrimental to the Hahner property. If the road is <br />straightened it will increase the amount of traffic and the speed of the traffic. Mr. Kasten <br />expressed concern about discrepancies between the Greiner drawing and the engineered plans. <br />There is intrusion onto the Hahner property and removal of two trees that have not been <br />addressed. The proposal also includes language that allows adjustments by the City as it sees <br />fit later on. The fact the City can interpret this as it desires without any public process is also <br />of concern. There is also the question of how Vineyard Avenue will ultimately proceed, which <br />is still under consideration and it is not clear how that will affect the Hahner property, if at all. <br />Mr. Kasten believed the Municipal Code as well as standard conditions of development puts the <br />responsibility for road improvements on the subdivider. He believed the responsibilities for this <br />road improvement clearly rests with the developer and with the City in light of the safety issues. <br />Mr. Hahner does not need increased access to his property, he already has that. The question <br />is whether his property will be improved and why should he pay for something that will not <br />benefit him. Mr. Kasten believed the answer is clearly no, and if Council feels the answer is <br />not clear, then any decision on this matter is premature. <br /> <br /> Jim McKeehan, 6612, Owens Drive, Vice President and General Counsel for Signature <br />Properties, indicated the reimbursement provisions for the water, sewer and emergency facility <br />are acceptable as structured. The real focus now is on the road improvement agreement. Staff <br />believes it would be easier to have a reimbursement agreement at the time there is a Specific <br />Plan so a financing plan could be developed for all the properties. One would then know what <br />the costs and benefits would be based on the actual uses of the properties. Signature advanced <br />all the funds for construction of the emergency facility without a reimbursement agreement. <br />However, there is a significant difference between a couple hundred thousand dollars and a <br />million dollars. Before advancing that much money, there needs to be a better understanding <br />of how the company will be reimbursed and not just vague references to some point in the <br />future. He questioned why the road needs to be built immediately. He felt the only reason was <br />because of safety concems. Signature requested the firm of CCS Planning and Engineering to <br />review the safety issues for this roadway to formulate solutions to the safety issues for an interim <br />period (until the specific plan is completed some time next year). That would then delay <br />construction and the reimbursement agreements until completion of the Specific Plan. <br /> <br /> Mr. McKeehan then reviewed the report and the options for signage and reflectors. He <br />realized that this was only a short term solution, but would be sufficient for the period it will <br />take to complete the Specific Plan. Signature Properties is prepared to pay the costs to install <br />these devices if Council agrees. He referred to the accident statistics and the number of <br />occupancies in Ruby Hill and stated his belief that there is no correlation to the increased traffic <br />and number of accidents on this road.
