Mr. Swift said there were many inquiries about changing its use. <br /> <br /> Ms. Dennis referred to the possible uses on this property which could be objectionable <br /> to the neighbors and felt there could be long discussions about whether a use could be <br /> conditioned in a way that a business could still function in this location. From all the problems <br /> there have been in the neighborhood, it is difficult for Council to permit similar uses. <br /> <br /> Mr. O'Leary pointed out that two of the C-S designated properties to the east have <br /> frontage on First Street and they still are entitled to C-S designations. <br /> <br /> Ms. Michelotti felt that when a use is allowed conditionally, it doesn't mean that you <br /> can't have it at all, it just means there are additional conditions, such as hours of operation, etc. <br /> When these applications are reviewed by the Planning Commission, that is what they look for. <br /> The message from staff is that some uses are not appropriate for this location period. <br /> <br /> Mr. O'Leary understood that, however, it is his position that the Planning Commission <br /> was correct in trying to achieve a compromise between the long-standing use of the property and <br /> reasonable requests from the neighborhood. He felt C-C as too far in favor of the residential <br /> complaints. <br /> <br />__ There being no further testimony, the public hearing was closed. <br /> <br /> It was moved by Mayor Tarver, seconded by Ms. Dennis, to adopt Resolution No. <br /> 96-54, approving a Negative Declaration for the rezonlng. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers - Dennis, Miehelotti, Mohr, Pico, and Mayor Tarvet <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> It was moved by Mayor Tarver, seconded by 1VIs. Dennis, introduce Ordinance No. <br /> 1684, approvlng the reZOn|ng Of approximately 1.02 acres located at 65 Ray Street to the <br /> PUD-C-C (Central Commercial), Donton Revlta!izatlon, Core Area Overlay District, <br /> subject to the conditions shown on Exhibit "A", as filed under Case PUD-96-01. <br /> <br /> Mr. Tarvet felt it was clear this property is adjacent to the residential neighborhood and <br /> has been a problem with the C-S zoning and he does not feel the residents should have to go <br /> through hearing after hearing as to what is appropriate for that site. This particular area is <br /> unique from the other areas and has as much to do with being adjacent to the residential area <br /> as being adjacent to the other C-S properties. <br /> <br /> 05/21/96 -20- <br /> <br /> <br />
