There being no speakers, the public hearing was closed.

It was moved by Mayor Tarver, seconded by Ms. Michelotti, to introduce Ordinance
No. 1681, to be read by title only and waiving further reading thereof, approving a
modification to an approved planned unit development to modify the five-foot side yard
setback requirement for five homes to reflect the existing encroac-hments of the homes'
porches, as f'ded under Case PUD-90-01-3M.
The roll call vote was as follows:
AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarvet
NOES: None
ABSENT: None
ABSTAIN: None

Item 6e
PUD-96-04. Zoning for the I)rOi~rtv is PUD
(Planned Unit Development} - LDR/A (Low Density Residential/At, riculture} District,
(SR96: 125)

Brian Swift presented the staff report.

Mr. Tarver asked what this does to the potential to bring all property owners together
and get the project on its way?

Mr. Swift indicated it furthers it because the potential purchaser of the school district
property could purchase the Gray property and other small properties in order to make the street
and infrastructure work.

Mr. Tarvet felt this was being done so a single property owner can get possession of all
the developable land and develop the property.

Mr. Swift said that is one result, but not what the original purpose was. Mrs. Gray
wanted to have two lots, so she could sell one and move to South Dakota. She would keep the
undeveloped parcel until the street and improvements are built to that point, and then she could
sell that.

Mayor Tarvet declared the public hearing open.

Judy Backer Gray, 530 Sycamore Road, indicated the back portion of the property would
be developed for houses, but the front portion is to remain the way it was. The staff worked
hard on this project and she thanked them.

05/07/96 -18-
