Mr. Pico felt that if a property has an obligation for future development, it is there and <br />should not be changed. The question with respect to Providian is whether the fee will apply to <br />the newest building. <br /> <br /> Mr. Swift stated that application will be coming before Council for approval and based <br />on Council's prior action tonight, staff would not recommend attaching that condition. <br /> <br /> Mr. Pico asked how much money would be available within a year if agreements with <br />Wells Fargo, Bernal, and Stoneridge were not approved? What is the status of the sewer <br />reservation if the agreements are not extended and Wells Fargo does not build before the year <br />2000? <br /> <br /> Mr. Roush answered the first question by saying there would be a reduction of $400,000. <br />If Wells Fargo does not build by 2000, the sewer allocations expire and there is no refund of <br />sewer fees. There is no expiration on the sewer capacity for Bernal because it is a different <br />situation. <br /> <br /> Mr. Tarver asked how much the Wells Fargo sewer prepayment was? <br /> <br /> Mr. Swift indicated it did not prepay; it purchased sewer allocations. <br /> <br /> It was moved by Mr. Tuner, seconded by lVls. Dennis, to approve the agreements <br />to allow the park obligations created by PUD condition 26 to be satisfied by assigning to <br />the City the NPID N. 1 and/or NPID No. 3 surplus. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was moved by Mr. Tuner to approve the agreements to allow the park obligations <br />created by separate agreement (Providian National Bancorp, but not Charter Properties or <br />CalProp) to be satisfied by assigning to the City ]N'PID No. I and/or NPID No. 3 surplus. <br /> <br /> A substitution motion was made by Ms. Michelotti, seconded by Ms. Dennln, to <br />approve the agreements to allow the park obligations created by separate agreement (the <br />third building for Providian National Bancorp, Charter Properties and CalProp) to be <br />satisfied by assigning to the City NPID No. 1 and/or NPID No. 3 surplus. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />05/07/96 -12- <br /> <br /> <br />
