Signature Properties came back to receive PUD approval for property on the west side of the <br />railroad track, the issue of a community park was in front of the Council. Council looked at <br />incorporating the five acre neighborhood park requirement into a community park. Council had <br />the option at that time to require Signature to pay in-lieu fees, dedicate land and improved park <br />land, to pay more than the in-lieu park fee would be in conjunction with development of a <br />community park, etc. Council elected to have the project pay in-lieu fees rather than have land <br />taken out of its development site, which brings us to where we are tonight. Signature has an <br />approved PUD and Council cannot now require it to dedicate land. That leaves Lot 60, which <br />is the eastern half of the 19 acres. Council will soon be looking at a new development plan for <br />that site. Council has the ability to require park land in conjunction with that pwject if it can <br />show it is reasonably related to the impact of that project. The original requirement was to <br />locate a five acre park in conjunction with the General Plan change for the 19 acres that would <br />serve not just the 79 acres but also all other high density residential sites in and adjacent to <br />Hacienda Business Park that had been modified for high density housing. <br /> <br /> E. J. Saucier, 5216 Genovesio Drive, felt it was unfortunate the community park has <br />been lost for North Plen~nton. He then referred to the assumption of 2.05 people per unit. He <br />felt because the houses are 3-4 bedrooms, the population would be higher (3 per unit) and using <br />the calculations in the staff report, that would require a 14.5 acre park. He felt the minimum <br />park should be ten acres. He agreed Council should buy the property offered for a park, but <br />should also purchase part of Lot 60. He urged Council to negotiate for a better price. Mr. <br />Saucier felt the fees generated from the developments would be $3.1 million. This would be <br />enough to purchase the property and develop the park. That is cheaper than a community park. <br />He pointed out that the linear park is paid for by the homeowners, not the City. He still felt <br />there was a requirement for the City to provide more parks. <br /> <br /> Derek Zemrak, 5222 Genovesio Drive, urged Council to purchase the land. He agreed <br /> with Mr. Saucier's request to purchase more land. <br /> <br /> It was moved by Ms. Michelotti, seconded by Mr. Pico, to purchase Lot 25A, and <br /> Parcel F, pursuant to staff recommendation. <br /> <br /> Mr. Tarvet wanted to make it clear that the staff recommendation was to purchase this <br /> 6.6 acres to meet the needs of the area.
