Mayor Tarver asked if there was a possibility of putting a tree in the back comer of the <br />yard to help screen the north side of the play structure. <br /> <br /> Mr. Broyer said he would have to take out some already existing fortiniums in order to <br />plant taller trees. The fortiniums are growing at a fast rate and soon would be to the first level <br />of the play structure. He would like to leave them in. <br /> <br /> Mayor Tarvet asked about the request for additional screening on the back side. <br /> <br /> Mr. Broyer said he could achieve screening by putting up safety boards across the <br />structure. <br /> <br /> Mayor Tarver felt the Crawleys and Battershells wanted a screening cloth on the back <br />side. <br /> <br /> Mr. Broyer said the purpose of the playhouse is to have it open, not closed in. He <br />already has incurred considerable expense. He said if there is a problem with the conduct of <br />the children on the play structure then the neighbors should contact himself or his wife. <br /> <br /> Mr. Pico asked if he were willing to accept a condition requiting him to put temporary <br />screening on the play structure until such time the foliage has returned the privacy to his <br />neighbors? <br /> <br /> Mr. Broyer said yes. <br /> <br /> Ms. Ayala appreciated Mr. Broyer putting up the additional screening, but did not feel <br />it was necessary. The trees will fill in over time and provide the screening needed. <br /> <br /> Ms. Battershell thanked Mr. Broyer and Council for resolving this. <br /> <br /> There being no further testimony, the public hearing was closed. <br /> <br /> Ms. Michelotti had visited the Broyer property and noticed the screening. She <br />appreciated Mr. Broyer's willingness to go to any length to resolve this. <br /> <br /> Ms. Dennis also appreciated the neighbors' willingness to work it out. <br /> <br /> Mr. Pico commended Mr. Broyer for creating a win/win situation. <br /> <br /> It was moved by Mr. Pico, and seconded by Ms. Dennis, to adopt Resolution No. <br />97-140, denying the appeal, thereby approving the design, with the additional condition that <br />Mr. Broyer will provide additional shade screening on the structure until such time as the <br />natural foliage provides screening. <br /> <br />Pleasanton City Council 12/02/97 <br />Minutes 10 <br /> <br /> <br />
