Mr. Swift said the draft agreement was revocable with a moratorium attached. If Council <br />wanted to modify it to include, "if the results of the West Las Positas study indicates that the <br />City cannot maintain level of service D at all North Pleasanton intersections the additional square <br />footage would be revoked." <br /> <br /> Mayor Tarver agreed to continuing it for thirty days. <br /> <br /> Mr. Swift asked for direction as to what Council would be satisfied with. <br /> <br /> Mr. Pico felt no one would front the money for the Canyon Way improvements as long <br />as its enfifiement was subject to be revoked. <br /> <br /> Mr. Swift said Taubman and Wells Fargo would be approached to build the <br />improvements. <br /> <br /> Ms. Acosta indicated Taubman was ready last Thanksgiving to proceed with putting in <br />the improvements. It was decided to wait until it was clear who was paying for what. <br /> <br /> Mr. Pico suggested the City advance the money and be reimbursed. Then the agreement <br />with Wells Fargo would not have to be modified and the additional square footage would not <br />have to be granted. <br /> <br /> Mayor Tarver said the improvements were supposed to have been built before they were <br />needed. <br /> <br /> Mr. Roush said there is $125,000 that other developers have contributed because building <br />permits have been pulled. If the City incurs the cost then it could demand Taubman to pay its <br />fair share of the improvements. There will still be a shortfall, but the City would not have to <br />pay for all of the improvements. <br /> <br /> A substitute motion was made by Ms. Michelotti, seconded by Ms. Ayala, to <br />continue the item to December 2, 1997. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico and Mayor Tarver. <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Pleasanton City Council 10/21/97 <br />Minutes 25 <br /> <br /> <br />
