Item 6c <br />Amendment to the Stonerid~_e Regional Shopping Center Development Agreement. <br />Further review of an application for an amendment to the Development Agreement which <br />would: (1) extend the term of the Agreement for five years: (2) allow an additional <br />development of 202.000 sa_uare feet fin addition to the 178.000 sa_uare feet of approved. but <br />not built. development) of leasable floor area in additional department stores. specialty <br />stores. and/or additional mall stores: (3) establish revised minimum _oarking ratios: and (4) <br />establish owners' obligations for further traffic mitigation improvements. The Development <br />Agreement would be applicable to 75 acres of the Stoneridge Regional Shopping Center <br />located within the Stoneridge Mail Road oval. Zoning for the property is C-R(m) Regional <br />Commercial (enclosed mall) District. (SR97:310) <br /> <br />Amendment to Sewer Agreement with Stoneridge Regional Shopping Center <br /> <br />Also consider adoption of a Negative Declaration <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Ms. Dennis asked if this was a revocable agreement. <br /> <br /> Mr. Swift responded that the City can suspend the approval based on the lack of traffic <br />mitigations. If that were done with a number of properties, it would also be applicable to the <br />Stoneridge Mall. <br /> <br /> Ms. Dennis asked where the boundaries were. <br /> <br /> Mr. Swift said the North Pleasanton area. <br /> <br /> Mr. Pico asked if this applied only to future development. <br /> <br /> Mr. Swift said yes. <br /> <br /> Mayor Tarver did not understand why an agreement was being put together when Council <br />had the ability to suspend the development rights in the future. If there is missing information, <br />why not get that information before signing an amendment to the contract. <br /> <br /> Mr. Roush said staff is recommending the agreement be approved at this time, but with <br />the understanding that if Council decides a moratorium or downzoning is appropriate, then to <br />the extent building permits have not been issued, this project could be suspended. <br /> <br /> Mayor Tarver asked what the burden was on the City, in a moratorium, to defend itself <br />in court as it relates to this application. <br /> <br />Pleasanton City Council 10/21/97 <br />Minutes 14 <br /> <br /> <br />
