Item 6b
PUD-8S-15-gM. City of Pleasanton
Consideration of a Planned Unit Development modification for land use alternatives for the
structure commonly known as the Bernal Adobe located at 1780 Foothill Road (SR97:273)

Brian Swift presented the staff report.

Mr. Pico asked if staff was recommending the access be through Golden Eagle Way and
not from Foothill Road.

Mr. Swift said staff explored that potential but the property does not have legal access
through the back of the property inW the project. The applicant wished to keep the driveway
access on Foothill Road. The Planning Commission recommended that the applicant seek to join
the Golden Eagle Homeowners Association and also to receive access from the back road. The
City has no way to require such access because the Golden Eagle streets are private.

Ms. Michelotti asked if this lot would stand alone and not be required to pay certain fees.

Mr. Swift said it would be subject to the Golden Farm PUD conditions, but would not
be part of the homeowners association.

Mayor Tarver preferred no access off Foothill Road.

Mayor Tarver declared the public hearing open.

Patrick Currin, 8279 Foothill Road, asked that the standard setback of 120 feet as stated
in the PUD be applied to this project and not the 150 feet setback as shown in Exhibit A.

Mayor Tarver asked why he wanted to change this.

Mr. Currin said a potential buyer might have different plans for a garage. The property
should have the same requirements as the PUD for the Golden Eagle Farms development. There
were no benefits for this property to join the Homeowners Association. He would like the
conditions of approval to be the ones approved by the Planning Commission, except for
condition three, which requires a landscape plan to be submitted "prior to occupancy". He
would like that changed to "prior to the issuance of building permits" for any improvements.

Ms. Michelotti asked if there was existing landscape.

Mr. Currin said yes.

Ms. Ayala asked staff's reasoning for Condition No. 3.

Pleasanton City Council 09/16/97
Minutes 9
