Ms. Michelotti asked each Councilmember if it was comfortable with the way the <br />ordinance read. <br /> <br /> Ms. Dennis said she was comfortable with all of it because the ordinance can be changed <br />over time if State or Federal laws change. There is an appeal process for the list. She felt the <br />ordinance needed to exist and then be changed as it evolved. <br /> <br /> Mayor Tarver agreed. He said the Federal government has done nothing about the <br />manufacturing of guns in California even though it banned the importation of guns in 1968. <br />Sometimes the local level has to take action to move the Federal and State levels. Had the State <br />government dealt with this issue, the local level would not be going through what it is going <br />through. He said there is an appeals process for those who do not believe a certain gun should <br />be on the list. He hoped the people who owned guns and had children in the homes had the <br />guns out of reach and also would educate the children on gun use. He felt people who owned <br />guns already knew how to remove the gun lock. He felt comfortable with the ordinance. <br /> <br /> Ms. Ayala asked about the Lafayette action. She said the report stated it might be <br />decided by the end of the summer. She asked if the trial court dismissed the law suit? <br /> <br /> Mr. Roush said it is speculative to know when the decision would be made and yes the <br />trial court dismissed the lawsuit. He said if Council introduced the ordinance today, then refer <br />the zoning regulation to the Planning Commission, both could come back later (on the consent <br />calendar) for the second readings. Or another way would be to introduce the ordinance today, <br />have the second reading in two weeks, and it would take effect in 30 days thereafter. The <br />zoning regulations would come before Council as a separate issue at a later date. <br /> <br /> Ms. Ayala asked Ms. Michelotti which way she would like it? <br /> <br /> Ms. Michelotti asked if in the time it takes for the Planning Commission to review and <br />make recommendations would there be a decision in the Lafayette matter? She reiterated her <br />concern about the gun list and that in the interim she hoped to have her concerns addressed. <br /> <br /> Ms. Ayala asked if Ms. Dennis would give Ms. Michelotti time to get her concerns <br />addressed and then perhaps she would support the motion. <br /> <br /> Ms. Michelotti said she does not want to have a legal challenge and wanted this to be a <br />good match for the community. <br /> <br /> Ms. Dennis said there are no junk guns being sold in Pleasanton, so how would it be a <br />good match for Pleasanton. She agreed to give Ms. Michelotti more time. <br /> <br /> Mr. Pico asked what the urgency was?
