He said no one takes care of the weeds around these vacant <br /> spaces. The main problem is the people passing through his property. The City has tried to <br /> address these issues but to no avail. <br /> <br /> Jerry Wagner, 4043 Nevis Street, said the gate is there for safety reasons. If there is a <br /> fire the people can use this to escape. The gate opens up to land owned by the City. He said <br /> people do not go through this gate because it is unlocked. <br /> <br /> There being no further public testimony, the public hearing was closed. <br /> <br /> Mr. Pico said this park has been around for a long time. Even though there were some <br /> nonconforming uses, they have existed for a long time. He did not see these issues as being <br /> items he wanted to discuss. He agreed with Geoff Cooper. The issue was whether to approve <br /> the thirty-three spaces or not. He did not see a significant problem in the continued use of the <br /> thirty-third space. He agreed in flexibility and to have only thirty-two spaces occupied at one <br /> time. If the applicants wanted to come back at a later date with a PUD, then let them. <br /> <br /> Mayor Tarver urged the applicant to apply for a General Plan change and a PUD plan. <br /> <br />_ It was moved by Mayor Tarver, and seconded by Ms. Ayala, to adopt Resolution <br /> No. 97-52, denying the appeal of Jerry Wagner for a Conditional Use Permit to add an <br /> additional mobilehome space as filed under Case AP-97-2/UP-96-45, clarifying the status <br /> of the mobilehome park as a pre-existing nonconforming use with the recognition of space <br /> 12A as one of the 32 legal spaces as long as another vacant space is removed, and directing <br /> staff to pursue all necessary steps, including legal action, to return the park to its pre- <br /> existing nonconforming use in the pleasanton mobilehome park located at 4202 Stanley <br /> Boulevard. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers - Ayaia, Dennis, Michelotti, Pico and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Ms. Michelotti said she was concerned about how to get the applicant to come back for <br /> the PUD. <br /> <br /> Ms. Dennis said there were two roads to take: one would be for Mr. Wagner to file the <br /> PUD application, and the other would be for the City to take legal action. <br /> <br /> Mr. Roush asked Council if it wanted to give some outside parameters as to when the <br /> applicant should apply before staff would take action. <br /> <br /> Pleasanton City Council 05/20/97 <br /> Minutes 26 <br /> <br /> <br />
