Mayor Tarver asked the applicant if they objected referring this issue to staff for the <br />development of the preannexation agreement? <br /> <br /> Mr. Faber said from a legal prospective he would like to see the preannexation <br />agreement, but he would like to move forward with the connection of the sewer. He asked how <br />long it would take for the City Attorney to develop the agreement? <br /> <br /> Mr. Roush said it would not take very long. <br /> <br /> Mayor Tarver asked if the agreement would be ready for the June 3 meeting. <br /> <br /> Ms. Michelotti asked if it would make sense to take an action at tonight's meeting on <br />whether to proceed with the sewer connection contingent upon the preannexation agreement. <br /> <br /> Mr. Roush believed the appropriate action would be to approve the staff <br />recommendations with the idea that the preannexation agreement would be returned to Council <br />for final approval. Presumably if an agreement can be reached between all parties, the item <br />would appear on the consent calendar for the June 3 meeting. <br /> <br /> Mr. Faber said he did not want to sign a preannexation agreement unless it was the intent <br />of the Council to only allow development that fits the existing life style. <br /> <br /> Mayor Tarver said he was in support of the requirements of the neighborhood that would <br />allow annexation. He said there is a need to proceed post haste to develop the conditions for <br />annexation. The only way to find out what the issues are is to have discussions. <br /> <br /> It was moved by Ms. Michelotti, and seconded by Ms. Ayala, to update the cost <br />estimate for the public improvements within the Remen Tract; to schedule additional <br />meetings with Remen Tract residents and the Council appointee to review staff <br />recommendations on minimum infrastructure required; to return the item to Council with <br />the appropriate resolutions to begin the annexation; to approve Rick Hempy/Mike Faber's <br />request to connect the proposed residences located on Linden Way and Vine Street to the <br />City water system, and to approve their request for connection to the City sewer system; <br />on the condition that the Council approves a Preannexation Agreement for the properties. <br />The r011 call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, and Mayor Tarver. <br />NOES: None <br />ABSENT: None <br />ABSTAIN: Concilmember Pico <br /> <br /> Ms. Michelotti volunteered to be the Councilmember. <br /> <br /> There was a break at 9:08 p.m. <br /> <br />Pleasanton City Council 05/20/97 <br />Minutes 12 <br /> <br /> <br />
