Brian McQuire, 233 Del Valle Court, felt that Signature Properties has had enough time. <br />He would like to see this project completed. Ruby Hill should pay its pro-rata share. Safety <br />is a big concern. <br /> <br /> Council adjourned to Closed Session at 9:40 p.m. to confer with legal counsel <br />regarding potential litigation against Signature Properties concerning the Vineyard Avenue <br />realignment. <br /> <br /> The meeting reconvened at 9:50 p.m. <br /> <br /> It was moved by Ms. Dennis, seconded by Ms. Michelotti, to adopt Option 4, that <br />Signature would build the road this spring and advance aH necessary funds to do so. In <br />return the City would agree to complete the Vineyard Avenue Specific Plan within two <br />years. <br /> <br /> Mr. Roush clarified that if during the two year period Council was prevented from <br />moving ahead with the project, the time frame to take action on the Specific Plan would be <br />extended. <br /> <br /> Mayor Tarver commented Signature Properties made an agreement and it had more than <br />enough time to complete the project. The issue is profit and loss and the community's interests <br />versus the developer's interests. He understands Councils desire to move forward on this. He <br />commented how upsetting it is that the City gave the maximum allowable park credit of $1.5 <br />million dollars based on the City's commitment but now turns around and lets Signature off the <br />hook for its commitment. He finds it totally unacceptable and would never support it.
