To match the <br />other solid walls it would have to be at least six feet. <br /> <br /> Mayor Tarver understood the original applicant could propose a major modification to the <br />PUD. The applicant has not done this but has indicated that it would be willing to do that. He <br />asked staff to explain what needed to occur to pursue this issue. <br /> <br /> Mr. Swift said the simplest way was to have staff ask the applicant to initiate the PUD <br />modification. The applicant has not taken out building permits. He was unaware if the applicant <br />had an issue. The applicant is working with the Homeowners Association and may be willing to <br />change the fence. <br /> <br /> Mayor Tarver wanted to stay away from giving direction to staff on an item that is not on <br />the agenda. He just wanted to know what process he should use to initiate the process to change the <br />fence. <br /> <br /> Ms. Acosta said staff would contact the applicant to see if the applicant is willing to pursue <br />this change. <br /> <br /> Ms. Michelotti asked if there had to be a heating to take action on the change. <br /> <br /> Ms. Acosta said yes and staff would schedule the hearing if there is to be a change. <br /> <br />6. (IR98:42) <br /> <br /> Sue Rossi presented the staff report. <br /> <br /> Deborah Acosta asked staff to address the lawsuit with Bank of America. <br /> <br /> Ms. Rossi said the lawsuit is about discrepancies that date back to the 1980's regarding the <br />accounting for bonds. <br /> <br /> Mr. Roush said the ways that Bank America tracked the bond money was primarily known <br />by the people who were involved in the actual work. A former Bank of America employee, Patrick <br />Stoll, challenged the way Bank America accounted for bond proceeds.
